Police will ask many questions when it comes to determining liability in a bicycle accident. When the driver of a motor vehicle collides with a bicyclist, there is a good chance that it is due to the fact that they did not notice the rider on the roadways. Were they speeding at the time? Were they driving distracted and took their eyes off of the roadway for one second too long? Police will also look at who had the right-of-way and if the cyclist was obeying all the rules of the road.
If recklessness played a role, the bicyclist might be able to hold the driver liable for any injuries that resulted. This means that the rider of a bicycle could hold the driver responsible for aspects of compensation such as hospital bills, future rehabilitation costs, lost wages, emotional suffering, and more.
