Report Finds Saturday Evening is Deadliest Driving Day of Week
The legal website Avvo recently evaluated car crash data and concluded that the deadliest time to be on the road is Saturday evening. The 6,802 fatalities on Saturdays were the most of any day of the week, while Friday was second with 5,826 and Sunday was third with 5,809.
The two-time slots with the highest fatality totals were the 6,201 accidents that occurred between 4 p.m. and 6:59 p.m. and the 6,067 crashes between 7 p.m. and 9:59 p.m. The day with the lowest total was Tuesday and the timeslot with the lowest total was between 7 a.m. and 9:59 a.m.
The report used data from the Fatality Analysis Reporting System (FARS) for 2016.
Fatal Car Accidents in California
When a person is killed in a motor vehicle crash in California, certain people may be able to file a wrongful death lawsuit against the negligent party. Under Code of Civil Procedure § 377.60, parties allowed to bring wrongful death claims include the decedent’s surviving spouse, domestic partner, and children. If there is no surviving spouse, domestic partner, or children, then any person entitled to the property of the deceased can bring an action.
A putative spouse, children of a putative spouse, stepchildren, and parents of a descendant can also bring a wrongful death claim when they are able to prove they were dependent on the deceased.
The damages plaintiffs can be awarded in these cases can vary. Most cases provide damages to cover funeral expenses. Additional damages may include medical bills, lost wages, and other noneconomic damages such as loss of consortium.
While families are understandably grief-stricken upon the sudden death of a loved one, quick legal action is highly recommended. A personal injury lawyer will usually need to conduct an extensive independent investigation in order to secure evidence and prove negligence.
Furthermore, state law in California only allows people two years to file wrongful death lawsuits. If you do not file your claim in court before the statute of limitations expires, you will lose your ability to hold the negligent party legally accountable.
