Wrongful Deaths in Fowler
A claim for wrongful death may only be filed by a surviving family member of the deceased. The deceased’s spouse, domestic partner, and children have priority in this situation, but if the situation is such that none of the aforementioned are alive or able, the wrongful death claim can be filed by a parent or other relative. You will have to verify your kinship to the deceased via certain legal documents, but it’s a reasonably straightforward process.
California does put a statute of limitations on filing a wrongful death claim, so while you shouldn’t make any hasty or emotionally-charged decisions, you do need to be aware that the clock is counting down and you need to address this distasteful matter as soon as you’re able.
