Wrongful Death in California
A wrongful death claim is a civil suit, not a criminal one despite the imposing nature of its name. A question of wrongful death arises when someone dies as the result of the carelessness, disregard, wrongful act, or negligence of another person. A wrongful death suit is a claim for monetary damages. This type of claim may be brought to court by a survivor of the deceased or a representative of the deceased’s estate. If the lawsuit ends up being successful, then the defendant would be ordered to pay the survivors of the deceased.
